Understanding How Personal Injury Cases Are Valued in California
One of the first questions every accident victim asks is: “How much is my case worth?” The honest answer is that every case is different. However, understanding the factors that determine your case’s value can help you make informed decisions and avoid accepting a lowball settlement.
At Smilove & Rosenblum, APC, we have recovered over $45 million for injured clients across California. Here is how personal injury cases are valued.
The Two Types of Damages in California
California law allows personal injury victims to recover two categories of damages:
Economic Damages (Special Damages)
These are your actual, documented financial losses:
- Medical expenses — emergency room, surgery, hospitalization, physical therapy, prescription medications, future medical care
- Lost wages — income you missed while recovering from your injuries
- Lost earning capacity — if your injuries permanently reduce your ability to earn a living
- Property damage — vehicle repair or replacement costs
- Out-of-pocket costs — transportation to appointments, home modifications, hiring help for household tasks
Non-Economic Damages (General Damages)
These compensate for losses that do not have a specific dollar amount:
- Pain and suffering — physical pain from your injuries and treatment
- Emotional distress — anxiety, depression, PTSD, fear, sleep disturbances
- Loss of enjoyment of life — inability to participate in hobbies, sports, and activities you enjoyed before the accident
- Loss of consortium — impact on your relationship with your spouse or partner
- Scarring and disfigurement — visible physical changes from the accident
California has no cap on non-economic damages in standard personal injury cases. The exception is medical malpractice, where MICRA (as amended by Proposition 1 in 2022) caps non-economic damages at $350,000-$500,000 with annual increases.
Key Factors That Affect Your Case Value
1. Severity of Your Injuries
This is the single biggest factor. Cases involving traumatic brain injuries, spinal cord damage, multiple fractures, or permanent disability are worth significantly more than soft tissue injuries. The more serious and long-lasting your injuries, the higher the value.
2. Strength of Liability
If fault is clear (rear-end collision, drunk driver, red light violation), your case is stronger. Under California’s pure comparative negligence rule, your compensation is reduced by your percentage of fault. For example, if you are 20% at fault and your damages total $100,000, you would recover $80,000.
3. Quality of Medical Documentation
Consistent, thorough medical records are essential. Gaps in treatment give insurance companies ammunition to argue your injuries are not as serious as claimed. Follow your doctor’s treatment plan, attend all appointments, and keep all records.
4. Insurance Policy Limits
California requires minimum liability coverage of only $15,000 per person. If the at-fault driver has minimum coverage and your damages exceed $15,000, recovering the full value of your claim becomes more complex. This is where underinsured motorist (UIM) coverage on your own policy becomes critical.
5. Impact on Your Daily Life
Juries and insurance adjusters consider how the injury has changed your life. Can you still work? Play with your kids? Exercise? Sleep through the night? The more your daily life has been disrupted, the higher the non-economic damages.
6. Pre-Existing Conditions
California follows the “eggshell plaintiff” rule — a defendant takes the plaintiff as they find them. If you had a pre-existing back condition and the accident made it worse, the at-fault party is still responsible for the aggravation. However, insurance companies will try to attribute your symptoms to the pre-existing condition.
Common Settlement Ranges by Injury Type
While every case is unique, here are general ranges based on our experience handling California personal injury cases:
- Minor soft tissue injuries (whiplash, strains): $5,000 – $25,000
- Moderate injuries (herniated discs, broken bones): $25,000 – $150,000
- Serious injuries (multiple fractures, surgery required): $100,000 – $500,000
- Severe/catastrophic injuries (TBI, spinal cord, amputation): $500,000 – $5,000,000+
- Wrongful death: $500,000 – $10,000,000+
These ranges are for illustrative purposes only and should not be taken as a guarantee of results. Actual case values depend on the specific facts and circumstances.

How Insurance Companies Try to Minimize Your Claim
Insurance adjusters are trained to reduce payouts. Common tactics include:
- Offering a quick, lowball settlement before you know the full extent of your injuries
- Requesting recorded statements and using your words against you
- Claiming your injuries were pre-existing
- Arguing you did not seek treatment quickly enough
- Sending you to their own “independent” medical examiner
- Delaying the claims process hoping you will accept less out of frustration
An experienced personal injury attorney knows these tactics and how to counter them effectively.
Why You Need an Attorney to Maximize Your Recovery
Research by the Insurance Research Council found that accident victims who hire attorneys receive settlements that are 3.5 times higher on average than those who handle claims themselves. After attorney fees, represented claimants still net significantly more.
At Smilove & Rosenblum, we:
- Investigate your accident thoroughly and preserve all evidence
- Work with medical experts to document the full extent of your injuries
- Calculate both current and future damages to ensure nothing is missed
- Negotiate aggressively with insurance companies
- Take your case to trial if a fair settlement cannot be reached
